Request for Variance
Any applicant may seek a variance from San Juan County Cannabis Regulation Ordinance No. 120 by submitting a Variance Application Form and $250.00 fee to the Community Development Department.
The applicant must apply for a San Juan County Cannabis Permit, prior to or at the time of variance request, and should include any relevant documents or materials which the applicant believes would support the request for variance.

Variance Application Form and $250 fee
- Applicant's name and address
- Date of request
- Description of the facility or activity for which the variance is sought
- including the Address or description of the the premises upon which the cannabis establishment or activity is located
Include all future activities in the Variance request to avoid having to re-apply for each type of state license (ex: retail, manufacturing, consumption - include type, production, etc.)
- Identify the section/subsection(s) of the Cannabis Ordinance from which the variance is sought
- Describe in detail the extent to which the applicant wishes to vary from the previously identified section/subsection(s) of the Cannabis Ordinance and how the applicant will ensure public health and safety is not negatively impacted
- State why the applicant believes that compliance with the Ordinance will impose an unreasonable regulatory burden upon the cannabis establishment or activity
- State the period of time for which the variance is desired, including all reasons, data, reports and any other information demonstrating that such time period is justified and reasonable.
Application Review Process:
- Community Development Department will gather evidence from all affected parties
- This will include notification to all property owners within the 300 foot radius of the cannabis establishment or activity
- Arrangements will be made for a public hearing:
- The purpose of the hearing is to provide interested persons a reasonable opportunity to submit data, views or arguments orally or in writing on the proposed variance
- Evidence collected by the Community Development Department will be submitted during the hearing
SJC Commission Approval:
- A summary will be presented to the Board of County Commissioners at a regularly scheduled meeting for final determination
